1. About Which Floor

Which Floor Realty Pvt. Ltd. (“Which Floor”, “we”, “us” or “our”) is a commercial real estate company providing property search, advisory and transaction facilitation services. Our services may include commercial office leasing, commercial property sale and purchase, pre-leased property opportunities, managed office and flexible workspace solutions, co-working and serviced office solutions, property search and advisory, property investment opportunities, property-related information and market assistance, space planning and related support, and other commercial real estate services.

Which Floor may facilitate communication between property owners, landlords, developers, tenants, buyers, sellers, investors, operators and other relevant parties.

2. Acceptance of Terms

By using the Website, you confirm that you have the legal capacity to enter into these Terms, the information provided by you is accurate and not misleading, you will use the Website only for lawful purposes, and you will not misuse, copy, scrape or exploit the Website or its content without permission.

We may update these Terms from time to time. Updated Terms will be published on this page, and continued use of the Website after an update will constitute acceptance of the revised Terms.

3. Nature of Our Services

Which Floor primarily acts as a commercial real estate advisory and transaction facilitation platform. Unless expressly stated otherwise, Which Floor is not the owner, landlord, developer, tenant, buyer, seller or operator of properties displayed on the Website.

Our role may include understanding requirements, identifying suitable properties, sharing property information, arranging visits, facilitating communication, assisting with commercial negotiations, coordinating transaction activities and connecting users with relevant professional or service providers.

The final transaction is between the relevant parties unless Which Floor is expressly made a party.

4. Property Listings

Users should independently verify all material property information before entering into a transaction. Which Floor does not guarantee that every property detail will always be complete, accurate, current or error-free.

6. Property Availability

Displaying a property does not guarantee that it will remain available. A property may be leased, sold, reserved, withdrawn, modified, offered to another party or subject to changed commercial terms without prior notice.

Availability should be confirmed with Which Floor or the relevant property representative before taking any decision.

7. Independent Due Diligence

Users are responsible for appropriate legal, financial, technical and commercial due diligence before entering into a property transaction.

Users may independently verify ownership and title, authority of the seller or landlord, encumbrances, approvals, RERA registration where applicable, building permissions, occupancy permissions, fire and safety compliance, property tax, permitted usage, lease rights, existing agreements, financial obligations and other applicable matters.

Which Floor does not replace independent legal, tax, financial, architectural, technical or regulatory advice.

8. Property Prices, Rent and Commercial Terms

Rental rates, sale prices, deposits, CAM charges, lease terms, lock-in periods, escalation clauses, parking charges and other commercial terms are subject to change.

Any price, rent, return, yield or commercial term shown on the Website should be treated as indicative until confirmed by the relevant parties.

Final commercial terms shall be determined through the applicable transaction or agreement.

9. Investment, ROI and Rental Yield Information

Which Floor may display information relating to rental yield, ROI, capital appreciation, rental income, investment returns, payback periods and other investment calculations.

Such information is for general informational purposes only. Past performance or estimated returns do not guarantee future performance, rental income, capital appreciation or investment returns.

Users should obtain independent financial, tax and investment advice before making investment decisions.

10. Property Enquiries

Users may submit enquiries through Website forms, phone, email, WhatsApp or other communication channels.

When you submit an enquiry, you agree that Which Floor may contact you regarding your requirement.

We may ask for name, mobile number, email, company name, location requirement, area requirement, budget, property type, lease or purchase requirement and other relevant information.

11. Lead Sharing and Property Introductions

To fulfil a property enquiry, Which Floor may share relevant user information with property owners, landlords, developers, property operators, managed office providers, co-working operators, sellers, authorized representatives or relevant service providers.

We will aim to share only information reasonably necessary for facilitating the relevant enquiry or service.

Use of personal information is also governed by our Privacy Policy.

12. No Brokerage Policy

The “No Brokerage” benefit is subject to eligibility conditions: the lease agreement must have a minimum lock-in period of 3 years; agreed monthly rental value must exceed INR 2,00,000; the transaction must be a leasing transaction; and the benefit does not apply to sale, purchase, transfer, assignment or other property acquisition transactions.

It also does not apply to property owners, landlords, developers, operators, managed office providers, serviced office providers, co-working operators, asset managers, property management companies or persons representing the property owner.

If eligibility conditions are not satisfied, brokerage, consultancy or other applicable fees may apply.

Which Floor may verify eligibility and modify, suspend or withdraw this promotional benefit.

13. Free Interior Layout

Where specifically offered, complimentary space planning or layout services may be provided after finalisation of the applicable transaction through Which Floor.

The complimentary service is limited to a basic conceptual layout and does not include, unless separately agreed, detailed architectural drawings, working drawings, MEP drawings, structural drawings, execution, project management, site supervision, government approvals or contractor management.

Availability and scope may vary.

14. Furniture Rental

Where furniture rental is offered, the arrangement may depend upon lease period, lock-in period, security deposit, furniture requirement, quantity, duration, pricing, delivery, installation and maintenance.

The final arrangement will be governed by applicable commercial terms or agreement. Third-party furniture providers may have separate terms.

15. Free Legal & Finance Advisory

Where offered, “Free Legal & Finance Advisory” may include an initial consultation with a relevant professional or advisor associated with or introduced by Which Floor.

The consultation is subject to availability and may be limited to an initial consultation.

It does not automatically include documentation drafting, representation before authorities or courts, or guarantee loan approval or any financial or investment outcome.

Continuing professional services may be subject to separate fees and terms.

16. Third-Party Services

Which Floor may connect users with legal professionals, financial consultants, interior designers, furniture providers, property managers, managed office operators and other service providers.

Third-party services may be subject to separate agreements and terms. Which Floor does not guarantee their performance, availability, pricing or outcome.

17. Third-Party Websites, Images and Reference Content

Websites and links displayed on Which Floor may be provided for informational and reference purposes only.

Third-party property images, photographs, videos, logos, floor plans, property information and other content may belong to the respective rights holder.

Which Floor does not claim ownership of third-party content unless expressly stated otherwise.

If any person or rights holder believes content displayed on our Website infringes rights, was used without authorization, contains incorrect information, or should be removed for any valid reason, they may contact us at info@whichfloor.in.

We will review the request and, where appropriate, take reasonable action, including correction, clarification or removal.

18. Which Floor Intellectual Property

The Website and Which Floor’s original materials may include the Which Floor name and logo, website design, original written content, blogs, graphics, videos, property descriptions created by Which Floor, calculators, data presentations, marketing materials and other proprietary content.

Except where otherwise stated, these materials belong to Which Floor or its licensors and may not be copied, reproduced, modified, distributed or commercially exploited without prior written permission.

Third-party trademarks, logos, photographs and other intellectual property remain the property of their respective owners.

19. User-Submitted Content

Users may provide information, photographs, property details, videos, floor plans, descriptions, reviews, testimonials or other content.

By submitting such content, you confirm that you have the right or authorization to provide it, the information is not knowingly false or misleading, the content does not unlawfully infringe another person’s rights, and it does not contain unlawful or harmful material.

You grant Which Floor permission to use such content for legitimate property listing, marketing and service-related purposes, subject to applicable law and our Privacy Policy.

20. Prohibited Activities

Users must not use the Website for unlawful purposes; provide false or misleading information; impersonate another person or organization; attempt unauthorized access; introduce malicious code or harmful software; scrape or extract property data without permission; copy our property database; systematically download property photographs or information; reproduce Website content for a competing database; interfere with Website functionality; use automated systems or bots without permission; infringe intellectual property rights; or use Website information for fraudulent purposes.

21. Anti-Scraping and Database Protection

Property listings, descriptions, images, structured data and other information available through the Website may represent substantial effort and investment by Which Floor and its partners.

Without prior written permission, users may not scrape the Website, copy listings in bulk, extract property databases, use automated crawling tools, republish Which Floor listings, or create competing property databases using Website information.

Nothing in these Terms grants ownership of Which Floor’s database or proprietary Website content.

26. Disclaimer of Warranties

Which Floor does not guarantee that the Website will always be available, property information will always be accurate or current, every listed property will remain available, a particular transaction will be completed, a third party will perform its obligations, or any investment will generate a particular return.

27. Limitation of Liability

To the extent permitted by applicable law, Which Floor shall not be liable for losses arising from reliance on property information without independent verification, changes in property availability or commercial terms, actions or omissions of property owners or other third parties, failed or cancelled transactions, third-party services, investment decisions, temporary Website interruptions, or unauthorized use of the Website by third parties.

Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law.

28. Indemnification

You agree to indemnify and hold harmless Which Floor Realty Pvt. Ltd., its directors, employees, representatives and service providers from claims, losses, liabilities or expenses arising from your breach of these Terms, misuse of the Website, false or misleading information provided by you, infringement of another person’s rights, unlawful activities, or violation of applicable law.
